Today we’re going to talk about how to make your payments in a Chapter 13 bankruptcy. Now this is important, because if you don’t make your monthly payments, your case is probably going to get dismissed. Your first payment is due thirty days after you file your Bankruptcy Petition, so this is something you have to pay attention to as soon as your case gets filed.

The first way to make your payments is through payroll deduction. If you’re in a Chapter 13, and you’re working a regular job, the Trustee is probably going to ask for the Chapter 13 payment to be taken out of your paycheck. This is the easiest way to ensure your plan payments get made, because you don’t actually have to do anything. Now, if you’re expecting a wage order to be issued, and you don’t see it coming out of your paycheck, then you need to make that payment yourself so that you don’t get behind. So let’s talk about some other mechanisms for making your payments.

One really efficient way to make payments is to submit them electronically. In the Southern District of Illinois, there are two mechanisms for doing this:

Finally, if you don’t have a wage order, and you’re allergic to technology, you can send your payments in through the mail to this address. This address is a special deposit box, where the Payments get securely processed, so payments are the only things you should send to this address:

The Trustee will not accept personal checks, so you’re going to have to send out either a money order or a cashier’s check. In either of these cases, there’s going to be a bit of a delay before you get credited with your payments. You want to make sure that The Trustee knows which case you’re making payments on, so it’s a really good idea to write your case number on the check or money order. I’m not saying that you shouldn’t make your payments this way, but if you have the option of doing it electronically, that’s probably going to be less expensive and more efficient.
